Throughout the Site, the Terms “I”, “we”, “us” and “our” refer to Foundland Ltd., “you”, “your” or “user” refer to the customer or recipients of our products and services.

Website, Products and Services

All descriptions of our products or product pricing are for your general information only and are subject to change at any time, at the sole discretion of us, without prior notice. We reserve the right to discontinue any product at any time.

We endeavour to present the most recent, most accurate, and most reliable information on our Site at all times. However, there may be occasions when some of the information featured on the Site contains incomplete data, typographical errors, or inaccuracies. Any errors are wholly unintentional and we apologise if erroneous information is shown or in any way affects your individual order. We expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Any reliance on the material on this site is at your own risk and for which we are not liable.

We have made every effort to display as accurately as possible the colours and images of our products but cannot guarantee that your computer monitor's display will be a completely true reflection.

Products and services on this website are provided ‘as is’ and ‘as available’, without any guarantees or warranties. This includes but is not limited to warranties of satisfactory quality, fitness for a particular purpose and non-infringement. We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

Use of our products is at the user’s sole risk. In no event shall Foundland Ltd be liable for any direct, indirect, punitive, incidental, special or consequential damages to property or life whatsoever, arising out of or connected with the use or misuse of its products.

You may not use our products for any illegal or unauthorised purpose nor may you, in the use of our Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

We reserve the right to refuse the sale of legally or age-restricted products. Knives and sharp objects can only be sold to those 18 years of age and older.

We use cookies to understand how people use our websites and to help us to make your experience of our websites better. We use Google Analytics as our data processor to collect anonymous information about how many people visit our site, which parts are most popular, how much time people spend on each section, and what information people are searching for.

Privacy Policy

The Site is owned by us, Foundland Ltd.

We don’t share your information. Your personal data will be used only to provide the information, goods and services offered through our website to you the customer, for billing and order fulfilment.

Payment card information is always encrypted during transfer over networks.

Right to Cancel

All customers have the right to cancel or return their orders within a specified time under The Distance Selling Regulations. Please refer to our Delivery & Returns section on the Site for our full Terms and Policies on how to return unwanted or unsuitable items for a refund or exchange.

If you are in possession of the goods you are under the duty to retain them and take reasonable care of them. You must send the goods back to us at our contact address at your own cost (unless the item is damaged or defective) as soon as possible.

Promotional Codes

Unless otherwise expressly stated in the terms and conditions for a particular promotional code, promotional codes cannot be combined and cannot be used in conjunction with any other offer or discount on the Site. If you have more than one promotional code, it is up to you to use the promotional code that has the biggest benefit to you.

Gift Cards

The terms below apply specifically to Foundland Gift Cards. Where there is conflict between this section and the rest of these Terms, the provisions in this section prevail for matters relating to gift cards. Your statutory rights are not affected.

What a Foundland Gift Card is

A Foundland Gift Card is a digital voucher that holds a balance in pounds sterling, redeemable against goods and services we sell on `foundland.com` and at any Foundland store that accepts gift cards. Gift cards are not a bank product, are not refundable for cash, and may not be exchanged or sold for any other form of value. Gift cards are issued by Foundland Ltd.

Buying a gift card

Gift cards can be purchased in fixed denominations or in a custom amount between £10 and £1,000. Payment is by debit or credit card via our usual checkout. We may apply daily purchase limits per customer to help us prevent fraud; if you'd like to buy a higher value than the daily cap allows, please contact us at hello@foundland.com.

Promotional codes cannot be used to discount the purchase of a gift card. Gift cards purchased with a promotional code applied to other items in the same order are unaffected.

Receiving a gift card

We send the gift card by email to the recipient address you provide at checkout. You can choose to send it immediately or to schedule delivery for a future date.

If the email bounces (the recipient address doesn't exist) or the email is reported as a complaint, we'll mark the card as undelivered and contact you. We'll resend to a corrected address on request, or we can cancel the card and refund your original payment.

We are not responsible for gift cards delivered to addresses that you provided incorrectly. If the email reaches the address you specified, we treat the card as delivered.

Using a gift card

A gift card can be redeemed in full or in instalments until the balance reaches zero. To use a gift card online, enter the 17-character code at checkout. The system will apply the chosen amount to your order; any remaining order total can be paid by card or another supported method.

Higher-value gift cards may require a PIN at redemption for additional security. Repeated failed PIN attempts will temporarily lock the card; if this happens, please contact us.

You can apply more than one gift card to a single order, up to the order total. Refunds for items purchased with a gift card are returned to the gift card's balance, not to cash or to the original payment method.

Expiry

Gift cards expire 24 months after the date of issue, or 24 months after the date of the most recent redemption - whichever is later. Each time you redeem any portion of the balance, the expiry date rolls forward.

We will email the recipient a reminder 30 days before a card is due to expire, where we have a working email address on file. Balances on expired cards are forfeited and cannot be reinstated, except where required by law.

Cancelling a gift card you've bought

You have the right to cancel a gift card purchase within 14 days of buying it, provided the card has not been redeemed in whole or part. If the card has been redeemed, the cancellation right no longer applies because the digital content has been supplied. To cancel, please contact us at hello@foundland.com from the email address used for the purchase.

If we cancel the card before any redemption, we'll refund the full amount to the original payment method. If the card was a gift sent to someone else, we'll only honour a cancellation request from the original purchaser.

Lost or stolen cards

Treat your gift card code like cash. We will replace a card only when:

  • the original delivery email bounced or was undeliverable through no fault of yours; or
  • we have other independent evidence (such as our records) that the card has not been redeemed.

We will not replace a card whose code has been forwarded, shared, or published by the recipient or purchaser, even if the card was subsequently used by an unintended party.

Faulty or unwanted goods bought with a gift card

Your statutory rights under the Consumer Rights Act 2015 are not affected by this section. If a product you purchased with a gift card is faulty, not as described, or otherwise eligible for refund, we'll process the refund back to the gift card balance the order was paid from. If the gift card has since expired, we'll restore enough balance to fulfil the refund and extend the expiry as needed.

Recipient data and privacy

When you buy a gift card for someone else, you confirm that the recipient is content for you to provide their email address and name to us for the purpose of delivering the card. We process this information in line with our Privacy Policy and only for delivery, customer service and fraud prevention. After a card is fully redeemed and the standard retention window has passed, we may pseudonymise recipient personal data while retaining transaction records as required by law.

We will not share a gift recipient's contact details with the purchaser.

Customer service

If something goes wrong with a gift card you've bought or received - wrong recipient, undelivered email, balance dispute, or anything else - please contact us at hello@foundland.com. We aim to respond within one working day.

For security, the original purchaser is the only person who can request a resend, an address change, or a cancellation. Resends are rate-limited to a small number per day per card.

Changes to gift card terms

We may update these gift card terms from time to time, in line with the general "Conclusion" section of these Terms. Any change applies only to gift cards purchased on or after the change date - gift cards already in circulation are honoured under the terms in force when they were bought.

Licence to Use the Site

This website contains material which is owned by us. This material includes, but is not limited to, content, product design, layout, appearance and graphics. Any redistribution or reproduction of part or all of this material in any form without our express permission is prohibited. Unauthorised use of this material or this website may give rise to a claim for damages and/or be a criminal offence.

Notices

All notices you send us must be sent to hello@foundland.com. We may give notice to you at either the email or postal address you provide to us when making a purchase. Notice will be deemed received and properly served 24 hours after an email is sent or three days after the date of posting of any letter. In providing the service of any notice, it will be sufficient to prove, in the case of a letter, that the letter was properly addressed, stamped and placed in the post and, in the case of an email, that the email was sent to the specified email address of the addressee.

Conclusion

Our Terms and Conditions apply to the use of this Site, and any products, services or information available through this Site. Your use of the Site or placing an order are subject to these Terms and Conditions.

These Terms and Conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants and/ or contributors of content.

We reserve the right to update or modify these Terms and Conditions at any time without prior notice. It is your responsibility to check this page regularly to ensure you are familiar with the current version.

These terms are governed by English law. Any contract for the purchase of goods from this site and any dispute or claim arising out of or in connection with any such contract will be governed by English law. You and we both agree that any claims should be brought under English law.
